Управління юридичним бізнесом в Україні на сучасному етапі та інноваційно-організаційні аспекти його удосконалення

Abstract

Стаття присвячена дослідженню управління юридичним бізнесом в Україні в сучасних умовах та інноваційно-організаційним аспектам його удосконалення. Висвітлено дані кількості суб’єктів юридичного бізнесу (юридичних осіб та ФОП) та тенденції їх регіонального розподілу. Виявлено значний рівень їх концентрації у столиці та великих економічних центрах країни. Константовано, що на територіальне розміщення юридичного бізнесу на даний час серед інших чинників істотно впливає необхідність релокації або припинення роботи частини компаній в умовах війни. Проведено дослідження динаміки започаткування нового юридичного бізнесу та припинення діяльності його суб’єктів за минулі роки. У результаті аналізування динаміки відкриття і закриття юридичних компаній та ФОП протягом 2021–2025 років встановлено нестабільність рівня активності підприємницької діяльності у сфері права. Відзначено при цьому значне перевищення кількості відкритих юридичних фірм над тими, що припинили свою діяльність, що засвідчує тенденцію розвитку підприємництва у сфері юридичного бізнесу й поступового відновлення активності бізнес- середовища після різкого спаду, що спостерігався у 2022 році внаслідок початку повномасштабної війни. Наголошено, що важливою складовою забезпечення успіху юридичного бізнесу є формування ефективної стратегії його розвитку. Розроблено схему формування основних видів напрямів менеджменту юридичної фірми, які включають: управління персоналом, управління юридичними практиками, маркетинг і бренд- менеджмент, управління відносинами з клієнтами (CRM), фінансовий менеджмент, управління інноваціями та LegalTech, проєктний менеджмент, управління соціальною відповідальністю ЮФ і ризик-менеджмент фірми. Встановлено, що сучасному етапі брак висококваліфікованих кадрів є гострою проблемою функціонування юридичного бізнесу. Проаналізовано структуру працівників юридичного бізнесу, відзначено поступове зростання у ній частки жінок. Виділено основні інноваційно-організаційні напрями удосконалення менеджменту юридичного бізнесу, до яких віднесено: впровадження інноваційних методів управління персоналом, оптимізація організаційної структури управління компанією та використання інструментів проєктного менеджменту, розвиток клієнтоорієнтованого підходу, забезпечення активного впровадження цифрових технологій у професійну діяльність суб’єктів юридичного бізнесу, розвиток маркетингової діяльності юридичної фірми та інші.

The article is devoted to the study of legal business management in Ukraine in modern conditions and the innovative and organizational aspects of its improvement. The article highlights the data on the number of legal business entities (legal entities and individual entrepreneurs) and trends in their regional distribution. A significant level of their concentration in the capital and major economic centers of the country has been identified. It has been concluded that the territorial location of legal business is currently significantly affected, among other factors, by the need to relocate or terminate the work of some companies in war conditions. A study of the dynamics of starting a new legal business and terminating the activities of its entities over the past years has been conducted. As a result of analyzing the dynamics of opening and closing legal companies and individual entrepreneurs during 2021–2025, the instability of the level of entrepreneurial activity in the field of law has been established. At the same time, a significant excess of the number of open law firms over those that ceased their activities was noted, which indicates the trend of entrepreneurship development in the legal business and the gradual restoration of the activity of the business environment after the sharp decline observed in 2022 due to the start of a full-scale war. It was emphasized that an important component of ensuring the success of the legal business is the formation of an effective strategy for its development. A scheme for the formation of the main types of law firm management areas was developed, which include: personnel management, legal practice management, marketing and brand management, customer relationship management (CRM), financial management, innovation management and LegalTech, project management, management of the social responsibility of the law firm and risk management of the firm. It was established that at the current stage, the lack of highly qualified personnel is an acute problem of the functioning of the legal business. The structure of legal business employees was analyzed, and a gradual increase in the share of women in it was noted. The main innovative and organizational directions for improving legal business management are identified, which include: the introduction of innovative methods of personnel management, optimization of the organizational structure of company management and the use of project management tools, the development of a client-oriented approach, ensuring the active implementation of digital technologies in the professional activities of legal business entities, the development of marketing activities of a law firm, and others.
